ES has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our data gathering and dissemination practices the provisions of which shall be used as a minimum for all ELS Web sites whether at the National, District or Squadron level, regardless of where they are located on the Internet. 

Upon Entering the Web site - Cookies: We compile information on the IP addresses that contact us so we can improve the services provided by our Site, but we will not provide that information to others. We may keep track of the pages you visited by placing a small entry in a text file called a "cookie" on your hard drive. The cookie contains an identifying number that allows us to track the pages you’ve visited on our Website. We may also use cookies to save your member access authorization (for a limited time, on our internal web pages) so you do not have to re-enter it each time you visit our Site. We may use member access authorization to maintain the privacy of our internal web pages. Information voluntarily provided by you may help us tailor our Site to your needs and interests. 

Cookies don’t reveal personal information. The only personal information a cookie can contain is information you supply yourself. Cookies can’t read unrelated data off your hard drive. Online Surveys: Our online surveys ask visitors for contact information (like their E-mail address). The contact information is used to contact the visitor when necessary. 

Requested Information: Whenever our site asks a visitor to provide information, we will provide the visitor the opportunity to decline to have their information used for subsequent notices about our products or publications or those of our associates. 

Privacy act & Security: We exercise care and diligence in managing, transmitting and securing personal information once we receive it. Clients and their personal information is protected by safeguards that are appropriate to the sensitivity of the information and are inline with currently available security technology / privacy laws under privacy act. Any information required in any case cannot be released without proper verifiable authorization. This may include use of document . passwords and encryption. It is important for you to understand that documents in all formats / data transmission over the Internet is not 100% secure. Despite our best efforts, we cannot guarantee the absolute security of any information you transmit to us or from our office to you , and you / we  therefore do so if required at your own risk.

R.S.O. 1990, CHAPTER F.31

Request

24.  (1)  A person seeking access to a record shall,  
(On plain paper, duly signed/notarized/verifiable by the person whom information belongs to).

(a) make a request in writing to the institution that the person believes has custody or control of the record;

(b) provide sufficient detail to enable an experienced employee of the institution, upon a reasonable effort, to identify the record; and

(c) at the time of making the request, pay the fee prescribed by the regulations for that purpose. 1996, c. 1, Sched. K, s. 2.  (our fee is $ 5 via check only payable to the name of corporation requesting to).

Frivolous request

(1.1)  If the head of the institution is of the opinion on reasonable grounds that the request is frivolous or vexatious, subsections (2) to (5) do not apply to the request. 1996, c. 1, Sched. K, s. 2.

Sufficiency of detail

(2)  If the request does not sufficiently describe the record sought, the institution shall inform the applicant of the defect and shall offer assistance in reformulating the request so as to comply with subsection (1). R.S.O. 1990, c. F.31, s. 24 (2).
Criteria re invasion of privacy

(2)  A head, in determining whether a disclosure of personal information constitutes an unjustified invasion of personal privacy, shall consider all the relevant circumstances, including whether,
(d) the personal information is relevant to a fair determination of rights affecting the person who made the request;
(g) the personal information is unlikely to be accurate or reliable;
(e) the individual to whom the information relates will be exposed unfairly to pecuniary or other harm;
(h) the personal information has been supplied by the individual to whom the information relates in confidence; and

(i)the disclosure may unfairly damage the reputation of any person referred to in the record. R.S.O. 1990, c. F.31, s. 21 (2).

Presumed invasion of privacy
(3)  A disclosure of personal information is presumed to constitute an unjustified invasion of personal privacy where the personal information,
(f) describes an individual’s finances, income, assets, liabilities, net worth, bank balances, financial history or activities, or creditworthiness;
(g) consists of personal recommendations or evaluations, character references or personnel evaluations; or
(h) indicates the individual’s racial or ethnic origin, sexual orientation or religious or political beliefs or associations. R.S.O. 1990, c. F.31, s. 21 (3).

Personal privacy

21.  (1)  A head shall refuse to disclose personal information to any person other than the individual to whom the information relates except,

(a) upon the prior written request or consent of the individual, if the record is one to which the individual is entitled to have access;
(f) if the disclosure does not constitute an unjustified invasion of personal privacy. R.S.O. 1990, c. F.31, s. 21 (1).
